These Booking Conditions form the basis of your contract for all bookings made with ExpertoItaly, (trading name of Alban Travel Ltd company number 04534551, incorporated 13th September 2002 whose registered office is situated at 116 kings Cross, London, WC1X 9DS).
1) Booking and payments
Up to a 40% deposit is required to secure a property. Upon receipt of this, we will confirm your booking and issue a full invoice.
Tailor made holidays
For holidays involving more components, the deposit of your holiday will be advised at the time of reservation.
The balance is due 8 weeks prior to your departure date. If you are booking less than 8 weeks prior to your departure date, the full amount must be paid to secure your booking. If the balance is not paid in time we shall retain your deposit and reserve the right to cancel your accommodation.
Payment can be made either by cheque, bank transfer, international money order, Switch, Solo, Visa or Mastercard. A handling fee of 2.5% will be charged on all credit card transactions, please note that this fee will not be refunded in the event of cancellation. There is no charge if you pay by any alternative method.
Once the deposit has been paid, it is understood that you have read and accepted these conditions of booking without a signature. The contract formed by the acceptance of these booking conditions is governed by English Law.
We suggest that you print out a copy of these terms and any confirmation of your order for your records. Upon receipt of the full amount, we will send you final details, including directions to the property.
2) Financial Protection for your Holiday
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong."
“We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).”
“If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arised out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.”
3) The final cost of your holiday
We reserve the right to adjust the cost of our holidays published on our website. You will be advised of the current price of the holiday arrangements you wish to book before your reservation is confirmed. Once confirmed, the price of your holiday is fully guaranteed and will not be subject to any surcharges.
Security Deposit (applicable to self-catering reservation)
Some property owners will ask for a security deposit to cover any breakages and / or extra cleaning.
The security deposit can be made either in Euros or in £s and should be made directly to the property owner upon arrival. The amount of the deposit requested is shown in individual descriptions as this varies for each property. Upon departure we ask that you leave the property in a decent state of cleanliness – e.g. washing up done, rubbish thrown out. The security deposit will be returned to you by the owners of the property upon your departure.
4) Holiday Insurance
ExpertoItaly does not offer Personal Travel insurance; we therefore strongly recommend that you and your party have the necessary insurance to travel. This insurance should cover all aspects of your holiday. See www.gov.uk/foreign-travel-insurance for more information on travel insurance.
If you have a problem during your stay, please inform the relevant supplier (e.g. your hotelier) and our overseas representative, if your are staying in one of our self catering properties, as soon as the problem arises who will immediately endeavour to put things right.
We will then investigate your complaint and respond to you in writing swiftly.
If you do not communicate any complaint to the supplier of the services in question as well as to our representative without delay we may be unable to investigate your complaint fully. This may affect your rights under this contract.
6) Cancellation by you
Should you need to cancel your booking after confirmation, the party leader must immediately advise us in writing. Your notice of cancellation will only be effective when it is acknowledged in writing by us at our offices (which we will do as soon as possible). Cancellations can only take effect during business hours (i.e. before or after our offices open/close) and must be notified by special delivery or email. The following cancellation charges will be payable. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total invoice cost excluding any amendment / cancellation charges which have already been incurred.
Period before departure within which written notification of cancellation is acknowledged by us
Cancellation charge (% of total invoice)
More than 64 days 30%
63-43 days 60%
42-29 days 80%
28-0 days 100%
Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned and we can supply a cancellation invoice upon request.
Please note that the cost of the flights included in your holiday arrangements is always 100% not refundable.
If you want to change the date of your booking, this will be treated as a cancellation of your original booking and a new booking will be created where the change can be made. Cancellation charges will apply to the first booking.
7) Cancellation or change by us
We accept no liability for cancellations that are a result of ‘force majeure’ – these are events which could not have been avoided even with all due care (e.g. natural disasters, terrorist actions, war, industrial dispute, water shortage, fire, adverse weather conditions, etc.).
We reserve the right to cancel your booking if full payment has not been received 8 weeks prior to the start of the holiday, and we shall retain the deposit.
In the unlikely event that we have to cancel or make a major change to your booking we will inform you as soon as reasonably possible and make every effort to offer you a suitable alternative.
If this is not acceptable, we will refund your deposit and any other sum that you have paid to ExpertoItaly.
We may on occasion need to make a minor change to your holiday; if this happens we will let you know as soon as reasonably possible.
8) Our liability to you
If the contract we have with you is not performed or is improperly performed by us, or our suppliers, we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements.
However we will not be liable where any failure in the performance on the contract is due to; you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with due care, could not foresee or forestall.
Our liability, except in cases involving death, injury or illness shall be limited to a maximum of one time the amount you have paid to us in respect of your holiday.
We act only as agents for the property owner and cannot accept any responsibility for the acts or omissions of the property owner or his / her employees.
Please note, it is the requirements and standards in Italy which apply to your holiday arrangements and not those of the UK. As a general rule, these requirements and standards will not be the same as the UK and may sometimes be lower.
